HURT WHILE WORKING?
What injuries are covered? In general, you are entitled to receive workers' compensation benefits for accidental injuries that are suffered at work.
What benefits can I receive?
You are entitled to have your medical expenses paid.
You are entitled to temporary total disability benefits in an amount equal to 2/3 of your average weekly wage while you are unable to work.
You may be entitled to benefits for permanent disability, disfigurement or death, depending upon the nature and extent of your injury.
Do I have to sue my employer? No. Workers' Compensation claims are administered at the Illinois Workers Compensation Commisssion (formerly known as the Industrial Commission), a state agency. You do not go to court.
Can I choose my own doctor? Yes. An injured employee may choose any doctor or hospital at the employer's expense. However, there is a limit to the number of medical providers that an employer must pay.
Should I talk to my employer's workers compensation representative? TALK TO NO ONE. After notifying your employer of your injury, you should not discuss your case with anyone other than your lawyer. The person who calls you next after you report your claim to your immediate supervisor may very well be an experienced claims adjuster working for your employer's insurance company. Before making any statement, discussing any figures or signing any document, get sound legal advise.
